Is this guy a dead beat?
Question by Notyme4BS: Is this guy a dead beat?
I posted this question yesterday, but I didn’t get a lot of resposnes so I’m reposting it.
I sat through a divorce trial for a class I took in college. I just happened to be between the principal of a local PUBLIC high school and his stay at hom wife. The couple had two children, one was a special needs child. When they were married the children were in private school. After the split the father didn’t want to pay for private school & wanted the children in public school. He even testified as his own expert witness on the ability of the public schools to provide special education (and the judge allowed him to testify as an expert witness on this matter).
The wife was asking child support, the marital home, that the children remain in public school, AND (now brace yourself) she wanted alimony until she went back to school to get her masters in speech therapy…and she didn’t have a bachelors. The wife had previously worked in private schools as a music educator and giving private lessons; however, she had no formal education.
I didn’t get to see the entire trial, just one day. However, the judge did admonish her for asking for too much. He said that he doesn’t think that he can order the father to continue to pay for private school (and asked her attorney to see if he can find case law on the topic). He also admonised her by saying, “You got married at 27 years old. You had an opportunity to get an education before the marriage. I’ll give you alimony, but definitely not in the amount you’re asking for and for long enough for you to get a masters. I’m sorry, but you’re going to have to get a job”.
I didn’t get to see the end of the trial, and this was year ago. However, I would like to hear some opinions as to why the father’s responsibilities should have been either personal opinion or according to the law?
BTW this was in California.
